Last night, the Federal Highway Administration submitted a memo to the court highlighting the weaknesses of Transportation Sec. Sean Duffy’s defense against the lawsuit filed challenging his illegal order to end congestion pricing. In response, Evergreen Action States Vice President Justin Balik released the following statement:
“Their own lawyers said it better than we ever could: Duffy’s case is flimsy, and his illegal order is falling apart. Their attempt to shut down congestion pricing was never grounded in law—it was a political hit job from the start. Now, the legal rationale is crumbling from within while public support continues to grow. After two failed ‘deadlines,’ they’ve lost the argument with New York, and soon they’ll lose in court. The truth is out, and it’s only a matter of time before it catches up with them.”
